What Is ERISA Health Insurance?

The Employee Retirement Income Security Act of 1974 (ERISA) is a federal law that sets minimum standards for most voluntarily established retirement and health plans in private industry to provide protection for individuals in these plans. It was passed by Congress and signed into law by President Gerald Ford on Labor Day, September 2, 1974. You can learn more about ERISA here on the U.S. Department of Labor’s website.

ERISA health insurance:

  • Imposes minimum standards for employer-sponsored health insurance, including documentation, reporting, and fiduciary requirements
  • Are established by private-sector employers for their employees, regardless of the states where they operate
  • Covers approximately about 136 million people, making ERISA health insurance the largest segment of the U.S. health insurance market
